Terms & Conditions
Effective 2026-09-08
DiveVerse is software for dive clubs and their members: it keeps a club's events, courses, equipment, dive sites and membership records, and gives its members an app to use them through. These terms are the agreement between you and Bainbridge Services (registration number I25008115), 30 Calodyne Bungalows, St Francois, Mauritius 31726, which provides DiveVerse. They cover both using the app as a member and running a club on it.
By creating an account or using the service you accept these terms. If you do not accept them, do not use DiveVerse.
What DiveVerse is, and is not
DiveVerse is a record keeping and organising tool. It is not a diving authority, a training agency, a certifying body, or a substitute for the judgement of a qualified Diving Officer, instructor or dive leader.
- Your club decides who is fit to dive, who is qualified for what, and whether a dive goes ahead. The app shows the club what it recorded; it does not make those decisions and must not be relied on as if it had.
- Prerequisite and qualification checks in the app are a convenience based on what people entered. They can be wrong if the underlying data is wrong. A human still has to check.
- Weather, tide, depth and marine data come from third party sources and are shown as a planning aid. They can be out of date or wrong. Never dive on them alone.
- Medical declarations are collected on your club's behalf. DiveVerse does not assess them and gives no medical advice.
Diving is a hazardous activity. Nothing here transfers responsibility for your safety, or your club's, to DiveVerse.
Your account
- You must give accurate information, particularly your qualifications and your medical declaration, and keep it up to date. Other people's safety depends on it.
- You are responsible for keeping your password and your device secure, and for what happens under your account.
- One account per person. Do not share it or let someone else use it.
- If you are under 16, a parent or guardian has to give permission before your account can be used. See the privacy policy.
- You can delete your account at any time from Settings, then My Data. See the account deletion page for what that removes and what has to be kept.
Content you post
You keep ownership of the photos, dive reports, messages and other content you put into DiveVerse. You grant us the licence we need to store it, show it to the people you shared it with, and back it up. You are responsible for having the right to post it, including where it shows other people.
Do not post anything unlawful, abusive, harassing, or that infringes someone else's rights. Do not post another person's personal data without their knowledge. Clubs moderate their own spaces and can remove content and members; we can remove content or suspend an account where these terms are broken.
For dive clubs
If you set up a club here, you are agreeing on the club's behalf, and you confirm you are authorised to do so.
- Your club is the data controller for its members' data and DiveVerse is your processor. That relationship is governed by our data processing agreement, which you accept at signup and which forms part of these terms.
- You are responsible for who you give administrator and Diving Officer roles to, since those roles can see members' health data.
- Your club's own terms, waiver and medical questionnaire additions are yours: you write them, and you are responsible for their content and their legality.
- Subscriptions are billed per plan. Fees are shown before you subscribe, exclude any tax we are required to add, and are not refundable for part periods unless the law says otherwise. You can cancel at any time and keep access to the end of the paid period.
- If a subscription lapses, the club's data is not deleted; features are reduced until it is renewed.
- Member payments taken through PayPal are between the club and its member. DiveVerse is not a party to them and does not hold the money.
Availability
We aim to keep DiveVerse running but do not guarantee it will be uninterrupted or error free. Parts of it depend on your internet connection, your device, and third party services outside our control. We may change, suspend or withdraw features, and will give reasonable notice of anything significant.
You are responsible for your device, its charge, and the data charges your network provider makes, including while roaming.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, DiveVerse is not liable for loss arising from diving activity, from decisions your club or you make, or from reliance on third party weather, tide or depth data. For anything else, our total liability to a member is limited to 100 GBP, and to a club is limited to the subscription fees it paid us in the 12 months before the claim.
We provide the service as it is, without warranties beyond those the law implies and does not allow us to exclude.
Intellectual property
DiveVerse, its software, design and trademarks belong to us. You may use the app for its intended purpose. Do not copy, modify, reverse engineer or extract the source code, or create derivative versions.
Ending this agreement
You can stop using DiveVerse at any time and delete your account. We can suspend or end access where these terms are seriously or repeatedly broken, or where we are required to. If we withdraw the service entirely we will give reasonable notice and a way to export your data first.
Third party services
DiveVerse uses services from Google, PayPal, Paddle, Zoho, Cloudflare, OpenStreetMap, iNaturalist and others, each under its own terms. The full list, and what each one receives, is in the privacy policy.
Changes
We may update these terms. We will change the effective date above and, for anything material, tell you in the app or by email. Continuing to use DiveVerse after that means you accept the new version.
Governing law
These terms are governed by the law of Mauritius, and the courts of Mauritius have jurisdiction. If you are a consumer, this does not remove the protection of the law of the country you live in.
